PLEASE TAKE NOTICE that the Village of Bellport Architectural Review Board will be holding a Work Session on Thursday, October 11, 2018 at 7 pm at the Bellport Community Center located at 4 Bell Street, Bellport.

NOTICE OF PUBLIC HEARING
PLEASE TAKE NOTICE that the Zoning Board of Appeals of the Village of Bellport will hold a public hearing on October 18, 2018 at 7:00 pm at the Bellport Community Center located at 4 Bell St., Bellport, New York to consider the following application:
Steven & Allison Hollman, 3 Circuit Road, Bellport, NY seek the following variances to construct a two story, 449 square foot rear addition;
Sec. 21-264. – Height.
The height requirements in a Residence B District shall be the same as in the Residence A District, as set forth in section 21-218 of this chapter.
Sec. 21-218. – Height (Pyramid Law).
In the Residence A District no building hereinafter constructed, erected or altered shall exceed thirty-two (32) feet in height, and must be set back from all property lines so that the height of any point of the building is not greater than the horizontal distance of the point from the nearest property line to the building or structure at that location or protrude through a diagonal line formed by a forty-five-degree pyramid angle from all property lines. Chimneys are exempt from said restrictions. Accessory buildings and structures shall not be subject to the pyramid law.
Proposed: The second story addition encroaches into the pyramid by 323 square feet.
Sec. 21-267. – Side yards.
In the Residence B District, there shall be two (2) side yards, one on each side of the building, the total width of both to be not less than forty (40) feet and no one side yard being less than fifteen (15) feet in width.
Proposed: New addition to be set back 12 feet 7 inches from the north side property line and the total width of both side yards to equal 39 feet 4 inches.
The Suffolk County Tax Map Number is 0202-7-4-26. The dwelling is located in the Residence B District.
All persons with an interest may attend and will be heard. The Community Center is handicapped accessible.

Sec. 21-1. – Definitions.
Accessory building. A building whose use is subordinate to or customarily incidental to an existing permitted principal building located on the same lot. The term “accessory building” shall include but not limited to: a private garage, shed, pool house, private green house, gazebo, pergola, pavilion, barn and children’s play house. No accessory building shall have a kitchen and/or bathroom facilities. No accessory building shall be used for sleeping or income producing purposes.
Sec. 21-216. – Use.
In a Residence A District, no building, structure or lot shall be used or occupied for any purpose other than one of the following:
(g) Accessory uses and accessory buildings, as defined in section 21-1, subject to the restrictions set forth in Division 1 of Article V, such accessory uses to include, among others:
(4) A building, structure and/or use, which is subordinate to or customarily incidental to an existing permitted principal dwelling, located on the same lot. Accessory buildings and/or uses shall include a private garage, shed, pool house, private green house, gazebo, pergola, pavilion, barn and children’s play house. No accessory building shall have a kitchen and/or bathroom facilities or used for sleeping or income producing purposes.
Sec. 21-417. – Restrictions.
Every accessory use is subject to the limitations contained in the definition of “accessory use” set forth in section 21-1 and is subject, additionally, to the following restrictions:
(4) An accessory building shall not have a kitchen, and/or contain facilities for cooking, and/or have bathroom facilities, and/or be used for sleeping and/or income producing purposes.
